RFID硬件提供商Intermec日前說他們已經向美國特拉華州聯邦地方法院提出了訴訟，以此來反駁AlienTechnology。在這起訴訟中，Intermec宣稱Alien的基于EPCglobalGen2協議標準的UHFRFID讀寫器與標簽侵犯了Intermec的10項專利權。Intermec正在尋求法院的禁令來阻止Alien繼續賣這些侵權RFID產品。Intermec也在尋求Alien因銷售Gen2讀寫器而獲得的金錢賠償。
6月初，Alien向美國北達科他州聯邦地方法院提出訴訟來反駁Intermec，該訴訟中Alien獲得的判決證明他們的RFID標簽和讀寫器沒有侵犯Intermec的10項RFID產品和加工的專利權。今天Intermec說他們也提出一個請求來反駁這次判決，因為北達科他州聯邦地方法院無權受理該訴訟。
"Intermec在北達科他州沒有任何業務，并且盡管Alien在那里有些業務，但并沒有把總部設在那里。"Intermec副總裁兼RFID業務總經理MikeWills說，以此來解釋對這個判決Intermec為什么確信北達科他無權受理Alien的訴訟，"通常，提出訴訟應該在跟公司業務有主要聯系的地方，這是個市場權限的問題。"
RFID知識產權保護已經日顯激烈
Alien訴訟中提到的10項Intermec專利權中的6項也在Intermec的侵權訴訟中提到了。這6項美國專利如下：

Wills解釋說Intermec從Alien訴訟中提到的10項專利權中選出的6項，連同另外4項被提到的專利權，都是Intermec相信被侵權的有力證據。
Intermec持有超過150項的RFID專利，從2004年4月起就卷入到這些專利的訴訟中，當時Intermec起訴Matrics（后來被SymbolTechnologies并購）侵犯了其4項專利。這是Intermec與Symbol間訴訟與反訴事件中最早的一起。
